Eugene Cross

Eugene Cross became a tenant of Chambers in September 2024 following the completion of his pupillage under Ian Mullarkey.

Eugene prosecutes and defends in both the Crown and Magistrates’ Courts. As a CPS Grade 2 Prosecutor, he has experience conducting Crown Court trials involving armed robbery, domestic strangulation, and putting a person in fear of violence. He also has experience representing clients at every stage of the process including first appearances, PTPH, sentences and subsequent POCA proceedings.

As well as cases brought by the CPS, Eugene also has experience defending in criminal cases brought by the RSPCA, Trading Standards, and local councils.

Whilst undergoing pupillage, Eugene completed the ICCA Children in Conflict with the Law training, which focuses on the specialist skills required for representing children, and advocacy in the Youth Courts. He has put that training to use in the Youth Court, representing children charged with offences including robbery and s.18 wounding, as well as when dealing with child witnesses in the adult courts. Recently, he prosecuted a child in the Crown Court charged with aggravated burglary.

Eugene is regularly instructed by police forces in a variety of civil applications to the Magistrates’ and County Court. These include Sexual Risk Orders, Sexual Harm Prevention Orders, Stalking Protection Orders, Injunctions and Closure Orders. He has also dealt with orders on appeal to the Crown Court. Eugene is currently working with Greater Manchester Police on the role out of the pilot scheme for Domestic Abuse Protection Orders.

Recent cases

R v JA [2025] (Sheffield) – Eugene was instructed to defend a vulnerable Defendant charged with stalking a stranger over a period of 14 months. Given his vulnerability and treatment that the Defendant was receiving already for his mental health, Eugene secured a 12 month conditional discharge.

R v KA [2025] (Bolton) – Eugene prosecuted a Defendant charged with strangulation. Part way through the Complainant’s evidence, she became overwhelmed and mute. Eugene made an opposed application to vary the special measures to allow the Complainant to be cross-examined over a link despite giving her evidence in chief in person. The Defendant was convicted. 

R v JR [2024] (Bradford) – Eugene defended a man charged with sexual assault in a nightclub. Eugene secured an acquittal notwithstanding the incident being caught on 16 minutes of CCTV and the Complainant being found unconscious in the toilet shortly afterwards.

R v MG (Bradford) – Eugene represented a Defendant who pleaded guilty to failing to stop following an accident in which he had hit a 7 year old child breaking her leg and leaving her lying in the road. The Defendant had stopped for a second before driving off. Eugene secured a sentence of 12 weeks suspended for 12 months and a 9 month disqualification from driving.

Recent cases

CCDP v PF [2024] (Birmingham) – Eugene successfully applied for a SPO where adult children wished to distance themselves from their father.

CCLP v JS [2024] (Leicester) – Eugene successfully resisted an appeal against a sexual risk order where the Appellant had learning difficulties. The Complainant was 35 years of age, but had a mental age of 8 or 9 years old and was therefore not capable of consenting to the relationship or sexual activity.

Before starting pupillage at KBW, Eugene volunteered for Leeds Free Legal Representation, a charity offering representation in the Employment Tribunal. As part of this role, Eugene dealt with cases involving allegations of racial discrimination, discrimination based on disability, victimisation and unlawful dismissal.
