Ed Moss recently appeared at the Royal Courts Of Justice where he successfully appealed an immediate custodial sentence imposed at Sheffield Crown Court. Ed was instructed by Emma Burkinshaw of Chris Stevenson Solicitors, Doncaster.
The case was unusual in many aspects, not least of which being that the appellant was granted bail by the single judge on the day that leave was granted. Following submissions, the Court of Appeal found that the immediate custodial sentence was manifestly excessive, reduced the term of imprisonment and suspended the sentence.
The appellant was a former member of the British Army who went on to serve overseas as a close quarter protection officer for various government linked departments. One of the key grounds of appeal was that the appellant had suffered severe injury during one of his deployments and was found to be suffering from undiagnosed PTSD at the time of the offending, a factor which had not been given proper consideration at the time of the original sentence.
