Acquittal for serving fireman

Richard Barradell recently secured an outright acquittal in R.v.Peedle June 2010 at Sheffield Crown Court. The case involved a serving fireman who was accused of crimes of violence in the city centre. The Fire Service carried out their own investigation into the allegations and compromised the police investigation by showing Fire Service Personnel photographs to potential witnesses before any identification parades had taken place. The Defendant had been suspended from work, with his livelihood and liberty in jeopardy. Richard Barradell's client, Mr Peedle, is now back at work, "doing the job he loves".


Edlington Boys case heard by the Court of Appeal

Edlington Boys case heard by the Court of Appeal: On 5th May the Court or Appeal, Criminal Division refused leave to appeal against the sentences passed on two brothers notoriously but wrongly dubbed the "Edlington boys" who, at the ages of ten and eleven, tortured other young boys. In giving the judgment of the Court, the Lord Chief Justice eschewed the Criminal Appeal Office's summary of the facts and quoted the bulk of the opening that Nicholas Campbell QC had presented to the Hon. Mr. Justice Keith at Sheffield Crown Court in January, prior to his passing indeterminate sentences of detention for public protection, each with a minimum of five years to be served. The judgment is a useful illustration of the principle set out in the authority of O'Brien [2007] 1 Cr. App. R. (S.) 442 at paras. 58-61, that a sentencing tribunal is able to increase the notional determinate sentence on the principal offence such as to take into account the overall criminality, for which see also Sentencing Guidelines Council: Dangerous Offenders, Guide for Sentencers and Practitioners, Version 2, July 2008, Part 10 at p.29.
