Employment Law Seminar
19th January 2012
Roxanne Frantzis, Nathan Moxon and Olivia Checa-Dover presented a two-hour seminar at the premises of Howarths Employment Law, an organisation offering full employment law support to businesses and organisations. The seminar was delivered to Howarths' existing and prospective clients. The topic was "what happens in an employment tribunal - tactical and practical advice."

Gavin Howarth, Director of Howarths Employment Law, had this to say about the seminar: "I just wanted to drop you a line to say a big thank you for last week. The seminar was a huge success and I know our clients, and some non-clients that attended, really enjoyed it. Olivia, Nathan and Roxanne were brilliant."

We are delighted to announce that all our criminal practitioners have been successful in their applications for the CPS Advocate Panel.

There were 24 successful applications from KBW for Advocate Panel Grading 50% have been awarded Grade 4 and all those counsel at Grade 4 level have been approved for the CPS rape panel.

KBW Hosts Inaugural BBP GDL Moot KBW Hosts Inaugural BBP GDL Moot

Chambers was delighted to host the first BPP GDL Mooting Competition on 12 March 2011.

The event was designed to provide advocacy experience for those who had not studied law as an undergraduate degree but wished to pursue a career at the Bar.

The standard was high as 17 entrants performed before two panels of judges who then had the difficult task of choosing a winner. So difficult, in fact, that it proved impossible and so two joint winners were announced - Sharon Tappin and John Bracken.

Clare Grant, GDL Programme Leader at BPP Leeds, said of the event:

"I am delighted that KBW Chambers organised this and gave our GDL students the opportunity to take part in the mooting competition, which was in some cases their first taste of advocacy. The competition has given our students the experience and confidence to continue to further develop their mooting skills in the future."

Driver accused of racing cleared of causing death by dangerous driving

Two members of a motorcar enthusiasts club locally known as the "Ponte Cruise" were prosecuted for causing death by dangerous driving. It was alleged that after the "Cruise" had met as it usually did on a Sunday night, it was suggested that a run to a meeting place at Wakefield should occur. It was further alleged that members of the group started to race against each other whilst en route. The lead vehicle in the convoy lost control and collided with on oncoming car tragically killing the lead vehicle's passenger. Shaun Bastow was driving the car behind the lead vehicle and was one of the first on the scene. After giving his details to the police he was eventually arrested for complicity in the offence. After a trial lasting six days at Leeds Crown Court Bastow's jury took less than an hour to find him Not Guilty. Bastow was represented by Richard M Barradell.


Gas Man Convicted of Gross Negligence Manslaughter

James Charlton, a CORGI registered plumber, has been convicted by a jury of the manslaughter of Mark Ellis, who had paid him to fit a new boiler within his South Yorkshire home. The jury was sure that, upon completion of his work, Mr. Charlton had failed to attach the flue to the boiler. As a result of that failure the respected and popular 41 year old probation officer had died, together with his cat; both had been overcome by the escaping carbon monoxide. Nicholas Campbell QC and Ian Mullarkey presented the prosecution case, which included evidence of six other faulty installations. In passing a sentence of five years imprisonment, His Honour Judge Keen QC indicated that he had considered the authorities of Regina -v- Johnson [2008] EWCA Crim. 2976 (a similar case on the facts, although that act of negligence had been an isolated incident) and R. -v- Appleby and others (Att.- Gen.'s Ref. no. 60 of 2009) [2009] EWCA Crim. 2693, in which the Lord Chief Justice had emphasised the importance of the sentencing tribunal considering the consequences of criminal conduct where life had been taken, whether intended or not. Although a longer sentence than that passed in the case of Johnson was justified in the context of the other negligent work, the sentence imposed also reflected the effect of Section 143(1) of the Criminal Justice Act 2003, which requires that the court assesses the offender's culpability in the context of the harm which the offence caused.

Boxer Free To Fight For World Title

EZEKIEL BROOK, the mandatory world challenger for the WBO World Welterweight title and latest superstar to emerge under the guidance of Brendon Ingle in Sheffield recently walked free from the Crown Court at Sheffield, his conviction for assault recorded at the Magistrates Court in Barnsley having been quashed. The Judge presiding described the identification evidence as questionable. Mr Brooke was represented by Mr Richard Barradell.

Whilst the conviction was extant Brook's licence to box, issued by the British Board of Boxing Control had to be suspended. Accordingly, this prevented him from being able to box competitively in the USA. Brook is now again free to box anywhere in the world.

KBW exploring future business structures

Recent governments have placed publicly-funded work for solicitors and the Bar under severe scrutiny. The Deficit Reduction initiatives being considered by the current administration will intensify this.

Whilst the initial prospects might not look good, forward-thinking lawyers will be reviewing all their options and may come to the conclusion that a closer commercial/business relationship between both major parts of the legal profession could be mutually beneficial.

The perceived importance of fixed-fee tendering is growing in the legal environment and the recent round of family franchise tenders has provided some surprising and salutary lessons which may be repeated in the criminal field. KBW, therefore, would welcome solicitors and other suppliers of legal services to contact us to discuss the possibilities of a closer working relationship which might lead to joint tendering in the next rounds of LSC franchise and other work areas.

Acquittal for serving fireman

Richard Barradell recently secured an outright acquittal in R.v.Peedle June 2010 at Sheffield Crown Court. The case involved a serving fireman who was accused of crimes of violence in the city centre. The Fire Service carried out their own investigation into the allegations and compromised the police investigation by showing Fire Service Personnel photographs to potential witnesses before any identification parades had taken place. The Defendant had been suspended from work, with his livelihood and liberty in jeopardy. Richard Barradell's client, Mr Peedle, is now back at work, "doing the job he loves".


Edlington Boys case heard by the Court of Appeal

Edlington Boys case heard by the Court of Appeal: On 5th May the Court or Appeal, Criminal Division refused leave to appeal against the sentences passed on two brothers notoriously but wrongly dubbed the "Edlington boys" who, at the ages of ten and eleven, tortured other young boys. In giving the judgment of the Court, the Lord Chief Justice eschewed the Criminal Appeal Office's summary of the facts and quoted the bulk of the opening that Nicholas Campbell QC had presented to the Hon. Mr. Justice Keith at Sheffield Crown Court in January, prior to his passing indeterminate sentences of detention for public protection, each with a minimum of five years to be served. The judgment is a useful illustration of the principle set out in the authority of O'Brien [2007] 1 Cr. App. R. (S.) 442 at paras. 58-61, that a sentencing tribunal is able to increase the notional determinate sentence on the principal offence such as to take into account the overall criminality, for which see also Sentencing Guidelines Council: Dangerous Offenders, Guide for Sentencers and Practitioners, Version 2, July 2008, Part 10 at p.29.

On 24th June 2011 Ian Mullarkey appeared before Wakefield Magistrates' Court on behalf of West Yorkshire Police in the biggest cash forfeiture application ever made by the Force. At the conclusion of the hearing a forfeiture order was made in the sum of £1,119,640.00.
